| Description of the problem | Struck from rear by another driver at high rate of speed; was thrown forward into driver side interior door panel and driver's head struck the convertible top metal top-folding structure. Believe the seat belt tensioner device failed to function properly and the air bag failed to deploy, as well. The convertible top for this model was in the up position at impact. The air bags did not deploy and the seat belt caused both the driver and passenger to lurch forward, causing serious bodily damage to both parties. Driver sustained brain injury and spinal injury and is still receiving treatment and surgery for his injuries. Passenger is also receiving on-going treatment for spinal and knee injury sustained as the result of the seat belt tensioner and air bag failure, as well. |
