Description of the problem	Failure of fuel tank level sending unit to accurately report actual fuel level in gas tank. Fuel level sending unit will indicate full fuel, or partial full and then drop immediately to below empty will fuel remains in tank. Nissan currently has a recall campaign (nhsta #10v075000) on the fuel level sending unit for 2006-2008 nissan xterras, which provides for the replacement of this part at nissan's expense. However nissan denied my claim under this recall stating that my vin number was not covered under the recall. I indicated that my vehicle was exhibiting the same problem that prompted this recall and that my vehicle should be included since my vehicle obviously had the same defect. Nissan north america refused to include my vehicle in the recall and i have been forced to replace the part at my own expense. Nstsa should require nissan to include all xterra vehicles produced by them for the years covered under the recall, especially those that are exhibiting the identical problems which precipitated the original recall, and not allow them to exclude certain vin units simply because they wish to do so.
