Description of the problem	Tl* the contact owns a 2008 mercury milan. The contact stated that while traveling approximately 5 mph, the contact attempted to decelerate and the pedal went to the floor. The contact then crashed into another vehicle. There were no injuries. The contact also mentioned that he erroneously depressed the accelerator because it was too close to the brake pedal. The vehicle was taken to a dealer where it was recommended that the brakes and rotors be replaced. The vehicle was repaired but the failure recurred. The manufacturer was contacted about the failure. The consumer stated his foot would accidentally hit the accelerator pedal, if he foot was not completely on the brake pedal, which caused the vehicle to surge. Both incidents, resulted in an accident.
